Terms of Service

These Terms of Service govern your use of BirdieIQ™ (the "Service"), operated by BirdieIQ LLC, an Arizona limited liability company. By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a school, club, or other institution, you represent that you have authority to bind that institution. If you do not agree to these Terms, do not use the Service.

BirdieIQ is a golf scoring analytics platform that provides decision-versus-execution analysis of tournament round data. The Service includes an iPhone application for players and a web portal for coaches and program administrators. Institutions subscribe to the Service under an annual site license.

The Service supports the following roles within an institution:

• Program Administrator (org admin): Manages the institution's subscription, coaches, and teams. Can view all teams within the institution.
• Coach: Manages their own team roster and views round data only for players on their team.
• Platform Admin (BirdieIQ): Operates the Service, manages subscriptions, and provides support.

Institutions are responsible for the accuracy of roster information and for ensuring that players have consented to data sharing before being added to a team.

Players must opt in to data sharing by joining a team with a roster code. For players under 18, the institution and coach are responsible for obtaining verifiable parental or guardian consent before adding the player to a roster. BirdieIQ relies on the institution to manage this consent and does not collect age information directly from players.

You agree not to:

• Upload or share round data without the player's consent;
• Use the Service to rank, shame, or publicly compare individual players;
• Attempt to access data belonging to another institution or team;
• Reverse engineer, decompile, or otherwise extract the Service's underlying logic;
• Use the Service in violation of any applicable law or golf association rule.

The Service is designed for conforming tournament play. Round data is only uploaded during signed BirdieIQ competition events with a valid time window. The iPhone app must not be used during a round in a manner that violates the rules of the applicable golf association. BirdieIQ is not responsible for rules violations committed by users.

BirdieIQ, the BirdieIQ logo, and all related marks are property of BirdieIQ. The Service's software, analytics, and documentation are licensed, not sold. Player round data belongs to the player and the institution; BirdieIQ processes it solely to provide the Service.

The Service is provided "as is" without warranties of any kind. BirdieIQ does not guarantee that analytics will be error-free or that the Service will be uninterrupted. Shot data and metrics are analytical tools, not official scores.

To the maximum extent permitted by law, BirdieIQ shall not be liable for indirect, incidental, or consequential damages arising from the use of the Service. Total liability shall not exceed the fees paid by the institution in the twelve months preceding the claim.

Institutions may cancel their subscription at the end of the billing period. BirdieIQ may suspend or terminate access for violation of these Terms. Upon termination, stored round data may be exported and will be deleted after a reasonable period.

These Terms may be updated as the Service evolves. The effective date will be updated when changes are made. Continued use after changes constitutes acceptance.
